Claiming for the wages of the migrant workers successfully

基本案情:
      多名原告是江苏的农民工,2017年6月至2018年10月期间,在内蒙古一个自然人承包人以单位名义承包的建筑施工项目上从事劳务工作,项目结束后,部分工资久拖不付,2019年10月,多名原告去挂靠单位催要欠款,挂靠单位让承包人出面解决,承包人出具了一份欠条和一份工资单,承诺最迟付款时间为2020年1月20日。时间届满原告仍然未收到工资,2021年年初原告通过国务院客户端反映被告(承包人和挂靠单位)欠薪事项,其后挂靠单位管理人员出面答应协调解决欠薪问题,但时隔一年仍未解决,故原告提起诉讼要求两名被告支付所欠的农名工工资。
basic case:
      The plaintiffs worked in the side of the architecture project during the period from the early 2017 to October 2018. The couldn’t get the salary of 2018 amounted to three hundred fifty thousand yuan. They were hired in the aforesaid project by Li who engaged in the architecture construction business with Zhe yi jian, a limited company having the qualification of architecture construction. They came to Tong Liao city Nei Meng Gu province where the project is to claim for there salary in October 2019, the manager of the company help them find out Li and Li promised to satisfy them till January 20th 2020 and affirmed that in written. But Li didn’t pay them, notwithstanding the company contacted them to negotiate this problem about several times , but it no longer contacted them from April 2022. The plaintiffs had to bring a litigation against Li and the company in early 2023.

不利因素:
      1.由于最后付款期限是2020年1月20日,2023年3月份起诉时可能会遇到时效方面的问题。
      2.没有直接证据显示两名被告之间系挂靠关系。
unfavorable factors:
      1.the deadline due to delivery the wages is on January 20th, litigating in March 2023 would result in a limitation problem.
      2.there’s no evidence to prove indirectly that Li engaged in the architecture construction business with the name of the company.

应对措施:
      1.原告可以通过在国务院客户端反映两名被告欠薪事项以及和挂靠单位的微信聊天记录主张时效中断,解决时效问题。
      2.上述第二个事实可以证明两名被告之间存在挂靠关系。
      3.根据保障农民工工资支付条例规定,建筑施工项目的实际承包人和挂靠单位对所欠的农民工工资应当承担连带责任。
Coping strategies:
      1.the plaintiffs can resolve the limitation problem in accordance with two subsequent factors: the first, one of the plaintiff represented all of them to claim for their wages by the client side of state council in February 2021; the second, the vice general manager of the company contacted them many times to discuss how to resolve their problem of wages in the period from April 2021 to August 2022.
      2.the second fact of above could prove Li used the qualification of the company to manage his business, therein Li owed the wages of the migrant workers.

http://       3. in accordance with the regulation about the payment of wages of the migrant workers, the nominal construction enterprise and the true construction person or enterprise should assumed the joint responsibility to pay the wages of the migrant workers.

法院判决:
      一审判决要求两名被告对欠薪事项承担连带责任。
Judgement or arbitration award:
      The basic court convicted two defendants of paying the wages of the plaintiffs.
