The Juridical Analysis and System Improvement of Non-Prosecution for Doubt

【Abstract】Non-Prosecution for Doubt is one of the forms of no prosecuting prescribed in the criminal procedure law. This is the detailed reflection of the principles of “doubtful crime as innocent” and “innocent assumption” in the criminal procedure law. But many disputes concerning the Non-Prosecution for Doubt do exist in the academic circle and the judicial practice. Based on the legal analysis of the theoretical foundation, value judgment, legal characteristics and criminal compensation responsibility, this paper presents juridical suggestions of improving the system of Non-Prosecution for Doubt.
