随着招标投标制度在我国建设领域的逐步推行和不断完善,建设工程招标代理机构应运、应时而生,并在近年来得到蓬勃发展,已成为活跃在建筑市场上的重要力量。招标代理业的兴起,在建设工程招投标领域产生了广泛的影响,在宣传普及法律知识、规范市场竞争行为、促进公平交易、提高招标效率、节约建设投资、遏制腐败等方面发挥了积极作用;
但同时在行业体制、招标人和招标代理机构等方面也存在着诸多不容忽视的问题,在很大程度上正制约和影响着我国建设工程招标代理行业的健康发展。 本文作者根据多年学习所得,并结合自身在建设工程招标代理工作实践中耳闻目睹的切身感受,力图在客观分析当前我国建设工程招标代理发展现状和问题的基础上,从行业管理和企业运作两个层面提出规范和促进建设工程招标代理业发展的应对策略、方法和措施。主要研究工作和成果如下: ①阐明了建设工程招标代理概念,并对其特征及性质进行了分析和归纳。
②探究了招标投标制度沿革和我国建设工程招标代理制度的由来,并介绍了国外工程招标组织形式和委托代理理论。 ③从法规体系、代理机构的法律地位及作用、市场准入条件、代理业务开展情况、从业队伍发展规模及分布状况等方面,比较系统、客观地论述了我国建设工程招标代理行业发展基本情况;通过分析和梳理,基本理清了该行业当前存在的主要问题,即:行业管理体制不顺、法规不够健全、招标人存在认识误区和不规范行为等三类机构外部环境问题,和代理机构缺乏独立性、从业人员素质参差不齐、代理工作质量差强人意、市场行为不规范、内部建设滞后等五类机构自身问题,同时还结合具体招标案例对其中部分问题进行了重点剖析。
④针对行业现实情况,以现行法律和委托代理理论为基础,从行业管理和企业自身运作两个层面对如何规范和促进招标代理业的发展进行了具体思索,提出了一系列有针对性且具有一定理论参考和实际应用价值的对策和建议。 a.探索了在现行法律框架下理顺我国建设工程招标代理行政监管体制的总体思路;对招标代理机构选择机制和服务质量信誉评价机制设计创新进行了较深入的探讨,提出了健全、完善建设工程招标代理相关制度规则的具体建议;阐述了加大监管查处力度和进一步发挥行业协会作用的的具体措施和途径。 b.论述了搞好招标代理机构内部建设和全面提升招标代理服务质量的五项具体举措:加强人才队伍素质建设、开展质量管理体系认证、加快企业信息化基础设施建设、建立科学的绩效考核评价机制、实施为顾客提供优质和增值服务的经营理念。 c.指出了建设工程招标代理机构的发展方向——工程项目管理公司。
With the gradually carrying out and unceasingly consummating of the bidding system in field of construction, tendering agencies for construction projects has been build and developed vigorously in the recent years, has become the important strength in the construction market. The rising of the tendering agency has produced broad effect in the field of construction projects bidding and has brought a positive role in propagating and popularizing the knowledge of the law, standardizing market competition behavior, promoting fair trade, improving bidding efficiency, saving construction investment, restraining corruption. Simultaneously,
there are a lot of problems allow of no to neglect in the industry system, tenderee and tendering agen- cices, which restricts and affects the health development of construction projects tendering agency business in our country. According to the learning gained for many years and the oneself personal experience ,based on objective analysis to the present situation and the problems of construction projects tendering agencices in china, the author brings the countermeasu re, method and measure to standardize and improve the development of construction projects tendering agency from industry management and enterprise operation. The main study job and achievement as follows
: ①Illustrated the concept of construction projects tendering agency. Analyzed and concluded the characters of the tendering agency for construction projects. ②Probed into the origin of the bidding system and the evolution of our country"s construction projects tendering agency system. Introduced the forms of oversea bidding organization and the theory of principal-agent problem.
③From the the law-and-regulation system, the legal position and function of the tendering agency, the market admittance condition, the agent business status, the team scale and distribution, systematically and objectively dissertated the basic development situation of tendering agency for construction projects in our country. Cleared up the main problem existed in this industry by analyzing and neatening. The three outside organization problems is that, the industry management system does not obey, the law and regulations is not enough to perfect and the tenderee has wrong understanding and behavior. The five inside organization problems is that, the agency is short of independence, employee quality is uneven, the quality of agent job is dissatisfied and the internal construction of enterprise lags. The author combines with the bidding cases and emphasizes an analysis to the part problem among them. (4) Be aimed at industry actual circumstances, based on the present laws and the principal-agent theory, how to standardize and promote the development of agent industry, which has been thought about from industry management and enterprise operation. Some valuable countermeasures and suggestions have been brought out. a. An overall approach of standardizing the government inspection system of the tendering agency for construction projects in present laws has been explored. The choose mechanism of the tendering agency and evaluation mechanism of the service quality credit have been discussed deeply. The concrete advice to establish and perfect system of rules and regulations of construction tendering agency has been brought. The concrete measure and way to strengthen inspection and increase the role of trade association have been set forth. b. The five acts to do well internal construction of tendering agency and entirely improve the quality of tendering agency service: strengthening diathesis of person with ability, developing authentication of quality management system, speeding up the progress of enterprise informationization, establishing a scientific evaluation mechanism of performance examination, actualizing a management idea of providing high quality and increasing value for the client. c. Pointed out the development direction of the tendering agency for construction projects--project management company.[page]
